Well, well, well... so RIT decides to find me in vioation of conduct, eh? Therefore, I will restart this war with them online, and here, is the mention of the new, forced contract:

This letter is to inform you in writing the action taken regarding your incident. The incident involved a violation of the RIT computer policy. You were using an unacceptable amount of bandwidth within the system, and were told previously to discontinue such use.

Based on the student conduct hearing conducted on 11/1/01 you have been found responsible for the following Conduct Code Violation(s):

You are hereby placed on Disciplinary Suspension as defined in the RIT Student Conduct Process:

. Disciplinary Suspension: exclusion from classes and/or priviledges and
. activities as set forth in the suspension notice for a definite period of time, generally not
. to exceed two (2) calander years.

This Disciplinary Suspension is deferred and in effect until 9/21/02, subject to your future conduct at RIT. The following conditions must be met in order for you to remain a student at RIT

. 1. If ant any time in the future you are involved in any further misconduct or
. violation of RIT rules and regulations, you will be suspended .

. 2. You are NEVER to run a server via the RIT system: This includes, but is not
. limited to the following:
. -No internet servers of any type, including:
. -no web servers, FTP servers, peer to peer client file sharing
. You MUST acquire an off-campus service if you choose to run a server of any sort.

. 3. ITS will continue to monitor your account(s) and your use of bandwidth. after
. turning your connections back on.

. Failure to complete this condition will result in your suspension from RIT.


Under the provisions of the RIT Student Conduct, you have the right to appeal this decision to the Institute Appeals Board. The following are grounds or purposes for appeal:

. 1. To determine whether the decision making process and/or hearing was conducted fairly
. in light of the charges and evidence presented and was in conformity with the RIT Student
. Conduct Process.

. 2. To determine whether the decision reached was based on substancial evidence, that is,
. relevant evidence that a reasonable mind would accept as adequate to support the
. conclusion.

. 3. To determine whether the sanction(s) imposed were appropriate for the violation which the
. student was found to have committed.

. 4. To consider new evidence which was not brought out in the original hearing and which is
. sufficient for a reasonable person to alter the decision.

. 5. To determine whether the deciding administrator or hearing body was biased or otherwise not
. able to consider the case objectively.

If you wish to appeal, you must notify Dr. Frank Lamas in writing no later than 11/21/2001. If you choose to appeal, the decisions and conditions rendered above will remain on hold until the appeal has been completed. Dr. Lamas' office is located in the Student Alumni Union, Room 2410.

Please understand that future attempts to become a student leader on campus may be jeopardized by the conduct sanction you are currently on.

Shall I comment now, just like I did in the past? Of course! Firstly, they sent it certified mail. Why? I won't lose sleep over that, though, but it WILL explain something that I'll get to, since I want to comment in letter order. In the beginning, they stated that I was told to discontinue such use. Wrong. I was told to not run it during the DAY. Nobody had tried to contact me about this, they just took action. Even the prior contract does NOT mention that I can't serve. Next, they said I was guilty of "failure to comply". What do they want me to do, bend over ass-backwards and kiss them? Hell no! Are they trying to cite this "prior knowledge" that never existed? Probably. Continuing along, there are the conditions. They will continue to monitor my accounts. Is that why I've been seeing port-scans from 129.21.3.71? (Info provided via my firewall.) Using a wonderful bot, I get this info: Rochester Institute of Technology (NET-RIT); 103 Lomb Memorial Drive; Rochester, NY 14623-5608; US; Good, Steven (SG631-ARIN) steven@rit.edu . He, is one of the higher-ups here at RIT. Around the page break, we have the grounds for appeal. Evidence is a key thing that came up, and I feel there was none. They gave me a 4 page printout of what was on my server, and doctored the computer clock to make it seem like the middle of the afternoon. When asked about seeing the actual bandwidth usage, their program "couldn't print that information". And, it was biased... the prosecutor got to remain in the room alone with the one making the decision. How do I know he wasn't feeding her a line of BS, to make me seem wrong? So why didn't I appeal? I got the letter on the day I was leaving for home. I went out of my way to the Post Office to get it. And, 11/21 was over the break! So I'm supposed to skip break for them? I think not! It ends with the issue of a leader on campus. Why do they not want me to be one? I'd expose the corruption, as would most of the people found gulity of any vioaltion. They don't want that. I will end by asking why Campus Safety got copies?
